1. Acceptance of These Terms

By downloading, accessing, or using Permitly (the "App"), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the App.

In these Terms, "Permitly," "we," "us," and "our" refer to GEN AICRAFTS LLC, a limited liability company organized under the laws of the State of Illinois (IL File Number 17972952), the operator of the App. "You" refers to the person using the App.

2. Eligibility and Age Requirements

The App is intended for people preparing for a DMV written exam. You should be at least 16 years old to use the App independently. If you are under 16, you may use the App only with the involvement of a parent or legal guardian.

If you are under 13, please use the App only with parental or guardian permission and supervision. The App is not designed as a service directed to children.

3. Educational License and Permitted Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial study purposes.

Educational Use Only

The App is provided for study and review only. It is not an official DMV product, does not provide legal advice, and does not guarantee that you will pass any DMV knowledge or written exam. Actual exam content, scoring, and legal requirements may change at any time.

4. Subscriptions, Billing, and Renewal

Some features of the App may require a paid subscription. Available subscription plans may include weekly, monthly, and annual options shown in the App at the time of purchase.

• Subscriptions are billed through Apple App Store or Google Play, depending on your device.
• Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current billing period, or as otherwise stated by your app marketplace.
• Prices, currencies, and tax treatment may vary by storefront, region, and applicable law.
• We use RevenueCat to validate subscription status and entitlements, but billing is processed by the platform store.

5. Refunds and Cancellation

Refunds and subscription cancellations are handled by the platform through which you made the purchase. We do not directly issue or manage store refunds.

• iOS: manage or cancel your subscription through your Apple Account subscription settings. Refund requests are handled by Apple under Apple policies.
• Android: manage or cancel your subscription through Google Play. Refund requests are handled under Google Play policies.

If you uninstall the App, your subscription does not automatically cancel. You must cancel through the applicable app marketplace.

6. Intellectual Property and Content Rights

The App, including its study flows, text, explanations, translations, design, branding, and original images, is protected by intellectual property laws. State handbook concepts may be based on public government materials, but our organization, translations, practice items, and presentation remain protected.

You may not copy, sell, scrape, republish, or redistribute the App's content except as allowed by law.

7. Prohibited Conduct

You agree not to:

• reverse engineer, decompile, tamper with, or attempt to extract source code from the App;
• circumvent subscription restrictions or misuse trial, purchase, or restore flows;
• copy, reproduce, or commercially redistribute App content without authorization;
• use the App in a way that interferes with its operation, security, or analytics integrity;
• use the App for unlawful, fraudulent, or abusive purposes.

8. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not promise uninterrupted availability, error-free operation, or that the content will always match the latest DMV testing standards in every jurisdiction.

To the extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, profits, or exam outcomes arising from or related to your use of the App.

We are also not responsible for decisions made using the App's study content, including reliance on explanations, translations, or practice results. You are responsible for verifying current rules with official state sources.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the App will be resolved exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of those courts.

Nothing in this section limits any non-waivable rights you may have under the laws of your country of residence.

11. Changes to the App or Terms

We may update the App, features, pricing, or these Terms from time to time. When we update these Terms, we will revise the version number and "Last updated" date on this page. Continued use of the App after updated Terms take effect means you accept the revised Terms.
